Former Edmonton Oilers owner Peter Pocklington might not spend any time in jail for perjury, according to documents filed in a Palm Springs, Calif., courtroom Wednesday.
The documents filed in U.S. District Court show the prosecution is seeking two years of probation and six months of house arrest.
In May, Pocklington pleaded guilty to perjury in a 2008 bankruptcy fraud case. Whether the 68-year-old businessman gets the sentencing proposed in the documents depends on the judge and Pocklington's willingness to file tax information that's been requested.
Pocklington filed for bankruptcy in August 2008, claiming almost $19.6 million in debts and $2,900 in assets. But he actually had control over two bank accounts and two storage units, he admitted.
Along with two years of probation, Pocklington may also be subjected to wear an electronic monitoring device, the documents say.
'Bogus' bankruptcy charges: Pocklington
Something not working in Pocklington's favour may be excerpts of an interview he did on Tuesday on CBC Radio's The Current with host Anna Maria Tremonti.
In the 10-page document of sentencing recommendations, the U.S. prosecutor's office calls into question that interview and says it has concerns regarding Pocklington's acceptance of responsibility in this case.
In the interview, Pocklington told Tremonti the bankruptcy charges against him were phoney.
"I was accused of bankruptcy fraud in two or three or four or five counts … whatever they like to count down here and all of them turned out to be absolutely bogus," he said.
Pocklington declined to comment on the recommendations when CBC News phoned him Wednesday requesting an interview.
Pocklington, who owned the Oilers through the years the team won its five Stanley Cups, is still remembered by many fans in Edmonton as the man who traded Wayne Gretzky to the L.A. Kings in 1988.
He also ran for the leadership of the federal Progressive Conservative party in 1983, a contest won by Brian Mulroney, who later became prime minister.
Pocklington's sentencing hearing is scheduled for Monday.
